BT Games is a retail business that sells video game consoles, PC and console games, and related products.

The services offered by BT Games (Pty) Ltd through its btgames.co.za website (hereafter referred to as "website") are subject to our Terms and Conditions of Use. Use of this website constitutes acceptance of all our Terms and Conditions without modification by the client (hereafter referred to as "You"). Please do not use this website if you disagree with these Terms and Conditions.

Please read these terms and conditions of use carefully before you accept them. We take by you doing any of the below that you accept these terms and conditions:

• you place an order through the BT Games website, or
• you make any use of the website of BT Games
• you visit a BT Games retail outlet

TERMS & CONDITIONS:

All standard terms and conditions of BT Games and advertised product suppliers apply. All offers expire on specified dates unless otherwise stipulated and are only valid while stocks last - promotional offers are generally valid while stocks last; some stores may sell out faster than others. Auto upgrades and DLC offers are on a first-paid-first-received basis, provided pre-ordered are collected at a BT Games store within seven days of release. All release dates indicated are merely a guide and are subject to change at any time without notice due to circumstances beyond our control. BT Games will inform customers of any changes via email or SMS. E&OE. All trademarks and logos used are the property of their respective owners.

We reserve the right to limit quantities of promotional items per customer. Furthermore, we reserve the right to refuse sales to dealers or resellers as we sell to end consumers only. Website pricing may differ from in-store pricing, and vouchers may not be able to be redeemed on website purchases. Original vouchers are valid for a single use/purchase and are not redeemable with a pre-order discount or any other promotional offer. Where applicable, promotional prices ("voucher price") have already had the advertised discount value applied and, as such, are not incremental.

Similarly, a displayed RRP may indicate the current promotional price. Certain offers may only be available in-store or online. Prices shown in advertising are for individual items on an "each" basis.

BT Games takes the utmost care to ensure that all advertising is correct. If any mistakes occur or BT Games advertises incomplete information, we undertake to display a notice in-store and online with the correct information. Stock availability may vary per store. Publishers may determine pre-order incentives, which are limited and may be substituted and changed at any time. Collector's editions, other premium versions of games, and selected consoles or hardware items require full payment within 48 hours to secure an order before we import the item for you. This payment is non-refundable should the order be cancelled within 14 days of release. Payment applied to secure an order for a collector's edition or any other premium version of an item will be forfeited if you do not collect within 48 hours of release. BT Games cannot be held liable for specific games or consoles that require internet downloads and updates before playing. No dealers. BT Games Advantage card benefits do not apply to any promotional offers. E&OE. Pack shot images of certain products may vary. All orders placed online for in-stock items or upcoming releases are to be paid for in full for an order to be valid (payments can't be made in-store when collecting orders placed on the BT Games website.).

Entire agreement

This agreement constitutes the entire agreement between BT Games (PTY) Ltd "BT Games" and the client "You".

BT Games reserves the right to suspend, withdraw or modify any or all parts of this website without notice to you, should the need arise. You agree that you will not hold BT Games liable for any inability to access the website, modification, withdrawal, suspension, unavailability or discontinuance of this website.

User Account

To purchase from this website, you must be 18 years or older, set up an account and provide a valid email address, ID number, cellular telephone number and home address. This must be the same registered address as your chosen card payment. Please provide us with the correct information to avoid cancelling your order.

You agree and warrant that your login and password are for your sole use and will not be disclosed to any third party. BT Games reserves the right to cancel or suspend your account if you breach any of these terms and conditions, provide false information, have reason to believe your account has been compromised or misuse this website. If your account is suspended or terminated, you may not use this website without our prior consent.

Accuracy of Information

BT Games will always reasonably endeavour to ensure the accuracy of information on these websites. BT Games makes no representation or warrant that any information on this website is correct or up to date. BT Games cannot be held liable for loss or damage caused by the reliance on this information. Packshot images of games are subject to change and may differ from the product you receive. In advertising, if we mention availability as "in-store", this refers to our "bricks and mortar" retail outlets and not the website - we refer to our web store as "online".

Age Restrictions

Games displayed on this website have been certified with Age Restrictions as per the Films and Publications Board of South Africa. You are responsible for ensuring that you, or the person you purchase the product for, meet the appropriate age requirement. BT Games reserves the right not to supply any age-restricted product where we reasonably believe a client is below the minimum age. Accordingly, you indemnify BT Games and all its suppliers should you purchase a product that is not age-appropriate or misrepresent your age. Similarly, the viewing of trailers may be protected by an age verification step; however, an adult or legal guardian must ensure minors are accompanied whilst viewing the BT Games website.

Agreement of Sale

All orders you place are subject to our acceptance. BT Games may elect to reject your order for any reason and will not be liable to you or anyone else in such circumstances. If BT Games does not accept your order, we will inform you as soon as possible via email or SMS.

Although BT Games always endeavours to ensure we only display products in stock and at the correct price, errors may occur. In those circumstances, we reserve the right to cancel your order, inform you by email, and refund any monies that may have been received.

Once you have placed your order, you will receive an acknowledgement of your order from BT Games. This does not constitute BT Games' acceptance thereof. An agreement of sales shall only be binding on BT Games once we have authorised your payment and received the monies in our bank account. An early reservation (one placed on this website before an actual price is known) does not constitute a sale.

Pricing

The product prices are set out on the website, and errors and omissions are omitted. The pricing includes VAT at 15% on vatable items but does not include delivery charges. Delivery charges will be set out at checkout and are valid only for deliveries within South Africa. We may only accept your order if a correct area code has been supplied, as shipping charges are based on these codes.

Pricing on this website may differ from that in our BT Games retail stores. Furthermore, digital games' pricing may vary from physical games in-store and online. Sometimes, the pricing may be lower than in-store and is only valid on this website. Our stores cannot lower a price to match an online price. All online pricing, promotions, bundles and offers apply to this website only and are not valid in our stores unless stated otherwise.

Pricing may change at any time and is subject to exchange controls. Please note that certain digital products (like online membership or wallet top-up items) are only sometimes supplied instantly upon order and may take a working day or more to complete, depending on the payment method.

If an incorrect price is displayed on this website, BT Games reserves the right to cancel the order and refund any payment made toward the order. In instances of inaccurate pricing, BT Games will contact you to inform you of the price changes and determine whether you wish to proceed. If BT Games cannot contact you, we will refund any money paid for the order. BT Games will only be obliged to provide products at the correct price.

All offers expire on specified dates unless otherwise stipulated and while stocks last.

Payment Methods

BT Games can only accept your order once you have paid in full. When you submit your order, you confirm that the payment card you are using is yours and that you meet the age restrictions for the game purchased. We only accept cards issued in South Africa and may reject any international cards.

Payment to BT Games can be made in any of the following ways:

Bank deposits and Electronic Funds Transfers.

You will receive our banking details if you elect to pay using any of these methods. You need to make payment for your order within seven (7) days from the order or forty-eight (48) hours if a premium version of a title is ordered; otherwise, BT Games will cancel your order. Please provide your order number as a reference when depositing your payment. If the full payment is not affected, then no delivery will occur. BT Games does not accept cheque deposits. Please note that BT Games will only update orders to confirm the status after payments have been reflected in the account.

Credit Card payments.

BT Games accepts Credit Card payments via MasterCard and VISA. We make use of Peach Payments to process all credit card payments. Peach Payments uses the strictest form of encryption, Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website or by BT Games. The transaction amount is presented to your card's issuing bank for immediate authorisation when paying an order via the website. Your BT Games order will be cancelled unless your bank's authorisation is obtained. BT Games will not be obliged to inform you of the reason for the refusal and will not be liable for any delay or non-delivery. BT Games is not liable for your card issuer charging you any fees due to us processing your credit/debit card. If, for any reason, we believe that the order may be fraudulent, BT Games reserves the right to cancel the order and refund any monies that have been paid. Payment is only collected from your bank once BT Games authorises the order. Your credit card must be set up for 3D secure purchases (see HELP section for details). Kindly note that due to the way credit card payments and refunds are processed (the total payment amount will be refunded directly to the credit card of the account used to make payment). 

Discovery Vitality Vouchers:

BT Games Discovery vouchers are valid online and in BT Games stores in South Africa. BT Games Discovery voucher is non-refundable and cannot be redeemed for cash, transferred, duplicated or sold. Each BT Games Discovery voucher can only be used once and must be redeemed before the reward expires. Only one BT Games Discovery voucher can be used per transaction. If the amount spent is less than the BT Games Discovery voucher amount, the balance of the BT Games Discovery voucher is forfeited. Availability and pricing of games apply at the time of redemption/download. For online purchases, you must create a BT Games account and accept the terms of use for BT Games. BT Games Discovery voucher will expire three months after being selected. BT Games Discovery vouchers can not be redeemed against digital vouchers sold by BT Games.

MobiCred.

Mobicred is an online revolving credit facility that allows you to shop on BT Games and repay the amount in monthly instalments. The displayed monthly payment indicates monthly pricing for 12 months at 22.25% interest per annum, including a monthly fee, but excludes a once-off account Initiation Fee. Please note that the interest rate is subject to change. NCRCP38/FSP 44481.

In-store collection for in-stock and pre-order items must be paid for online.

If you elect to collect your order from one of our stores, payment must be made online upon placing your order. Please take your ID or Driver's licence with you when collecting it so that we can verify that you are the person who paid us. Note that you must wait for our communication to collect your order; an email from Peach Payments confirming your payment or from us confirming your order does not suffice.

Merchant Outlet country and transaction currency

South Africa is the merchant outlet country that presents payment options to the cardholder. Transaction Currency is South African Rand (ZAR).

Regional Restriction

The offerings on this website are only available to individuals residing in South Africa.

Delivery

BT Games will only ship within South Africa's borders and does not ship to postal addresses. All orders to main centres are shipped via a courier service. Certain larger or heavier items are only shipped using an economy service, but most games are shipped overnight. Please read our Shipping Policy page for more details.

We will ship all available items, where reasonable, within 48 working hours from our warehouse in Johannesburg. Orders placed over a weekend will be shipped within 48 hours from the first working day after that. If we cannot ship your order within seven days from the order date, we will cancel it and refund any payment you may have made.

In-Store Collection

If you elect to collect your order from a store, please wait for confirmation via SMS or email that your item is ready for collection at your chosen store. Only go to collect once this has occurred; an email from Peach Payments confirming your payment does not suggest your order is ready for collection. It could take up to 14 days for the store to receive stock for your order.

Internet connectivity and available bandwidth

Many consoles, games or game add-ons require an internet connection to update, redeem and play. All internet, broadband and bandwidth fees are for your account, and BT Games cannot be held responsible for any costs incurred. We also recommend familiarising yourself with your PC settings regarding software updates.

Pre-Orders

Most pre-orders will be shipped 24 hours before the advertised release date. Unfortunately, delays may occur due to unforeseen circumstances. Publishers may move release dates, or goods can be delayed due to customs and shipping issues. BT Games cannot be held liable for any of these occurrences.

BT Games reserves the right to limit quantities and not supply dealers. In certain instances where codes or physical items are offered with pre-orders, BT Games may restrict the code or item to one per customer and one per order only.

Publishers often provide BT Games with pre-order incentives through free physical items and DLC (downloadable content) to secure pre-orders. These incentives are subject to change and may be limited or altered. All pre-order incentives will be distributed on a first-paid, first-served basis and usually ship with your game. You are not entitled to a pre-order incentive if you do not collect the pre-order. Codes for digital content are sent to collected pre-order customers within two days of the game being received and by SMS only. BT Games advertising exclusivity on such digital or physical pre-order content is meant to be relative to other physical retailers in South Africa, not other retailers outside of South Africa, and not to digital stores such as Xbox LIVE or PlayStation store.

Due to the Rand's volatility against major currencies, all pre-order prices are subject to change. In the event of a change in the price, advertised features or product offerings, BT Games will contact you with the revised information, and you will have the opportunity to cancel or amend your pre-order. In the instance of a price decrease, you will also be informed, and any difference in money you pay will be returned.

You may elect to collect a pre-order at any of our stores nationwide (excluding digital content). At checkout, you will be asked to choose a store for collection. If you wish to change this later, please email our orders department.

Pre-Owned Software

Under the Second Hand Goods Act of 2009, all orders for pre-owned software must be placed by someone over 18.

When collecting your pre-owned game/s, you will be required to provide BT Games with

1. Your South African barcoded ID book or Driver's license.
2. Your residential address and telephone number.

Cancellation Policy

You may cancel your order before BT Games ships it to you. Any refunds will be processed within ten working days of the cancellation. Refunds will be processed as if the original payment was made, where possible.

If BT Games has shipped an item to you and you wish to cancel the order, it will be subject to our returns and exchanges policy.

Any returns may be subject to a handling fee. BT Games reserves the right to access all returns and apply restocking fees at our sole discretion.

If we deliver a damaged or defective product, BT Games will uplift and ship you a replacement product at our expense, provided it is reported within 48 hours of receipt. This does not apply to digital downloads.

All returns after ten days will be subject to the manufacturer's warranties and guarantees.

Communications: when a user visits any BT Games website or sends correspondence via email to BT Games, that user consents to receive electronic communications from BT Games.

Customer privacy policy

BT Games shall take all reasonable steps to protect users' personal information. For this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from http://www.polity.org.za/attachment.php?aa_id=3569.

Responsibility

BT Games takes responsibility for all aspects of the transaction, including the sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Disclaimer

All promotions, bundles, offers and coupons are for use only on our website and may pertain to the physical or downloadable product. BT Games reserves the right to limit or cancel quantities purchased per person, per household, or per order and limit or prohibit sales to dealers. BT Games is not responsible for typographical errors, price variances, or manufacturer omissions or delays. All offers, policies, coupons and promotions are subject to modification and termination at any time.

Indemnification

BT Games provides this website on an "as is" basis. BT Games makes no representation or warranties of any kind, expressed or implied, as to the operation of these websites, the information, the content, the materials, or the products included on this website to the full extent permissible by the applicable law. If any part of these Terms and Conditions is considered illegal, invalid or unenforceable, such provisions will be severed, and the remainder of these Terms and Conditions shall continue in full force and effect.

BT Games' failure to enforce a right does not result in a waiver of such right. You may not assign or transfer your rights under these Terms & Conditions.
